    Adding another name
    My son wants to add his stepdads last name not removing his birth dads last name just adding it at the end so it shows both can it be done or is it something I have to go to court and do? It's not a removal of his birth fathers last name or anything he's just adding a name

    Do you mean add it to and have two men listed on the birth certificate ? No that is not possible.

    Do you mean he wants to do a name change and just add name ?

    How old is your son ? If he is over 18, he can just go to court and do a name change.

    If he is not 18 you will have to file along with the bio dad signing his permission for it.

    Example.. His legal name is Carlos Diaz and wants it to be Carlos Diaz Lopez? Diaz is his fathers last name Lopez is his Stepdads

    A birth certificate is a legal document. It requires a court order to change it. For a minor both parents must agree to the change.

    An add is a change. ANY modification to the legal name requires a court order.

    You are CHANGING his name, adding a name is a name change, and no you can not just add it to social security, you have to legally change his name, before any change to social security can happen.

    You do a name change though the local court, in GA it is done though Probate court, and both you and the bio father has to agree.

    There is no other way to CHANGE his name and this is a name change.

    This is not correct. There is no such "amendment." The person needs a Court Order to amend the birth certificate. That Order is not called an "amendment."

    Judy, what I was saying was you can't just change the name on a social securirty card, you have to change the name on the birth certificate first in order to get a new ssc. And in order for them to do that, yes, if both parents don't agree, it has to be filed in court for a court order.

    Which is what was already said in responses 6 & 7. You have to be careful answering legal question to make sure they are accurately stated.

    I understand this, ScottGem, however, the Gia78 was asking about just changing the ssc and not the birth certificate, so I was clarifying that she couldn't do that.
