It is usually about 12 years old. You might want to check this website: FREQUENTLY ASKED QUESTIONS - CHILD CUSTODY

Most likely you will have to go back to court and have them rule on it, since refual to allow him to go would be a contempt of court, you need to clear this though family court

I agree with the above. Furthermore, I child can be coached by a parent to say they don't want to be with the other one. It gets complicated. You need to investigate custody laws for your state.

A child doesn't get to decide. The adults are responsible for making decisions in his/her best interest. Even though the child doesn't want to go... you have no right to allow them to decide. Same as if they didn't want to go to school. Unless there is some extreme reason you should not allow the child to make the decision. Try to find out why they don't want to go. If it's just because they are closer to you, don't want to miss friends/events, or cannot come up with a reason... there are no grounds for not making the child go. Kids can be very sensitive to the parent they live with and may take sides or even try to manipulate things. Without a REAL reason... they must go. If there is a reason that should be looked at further you need to get counseling for the child and go back to court. The child's view may be looked at but most judges still won't put full stock in a 12 yr. old without extreme reasons for not wanting to go. Judges are less likely to listen to 12 yr (unless there is proven abuse) old than they used to be as there are so many custody battles. Parents often involve kids and kids often go through rebellious times when they don't want to go. Basically, investigate the reason. Then get help with counseling/lawyer or be the adult and make the child go. Both parents have rights to be with the child. Child doesn't have to like it.

Have gone through this with two of my kids. Neither had reasons of abuse. Just didn't like rules, missing events with friends, and missing siblings not having same father.

    Good luck.

The child can decide if they don't want to see the parents anymore at about 13-14 years old and maybe younger but I am not sure. I don't know the situation and it may not work in certain situations.
