I have lost everything in the last 8 months HOuse ,car family.
My wife has always been abusive. The past for months I have sunk into depression drinking way too much fighting and arguing with my wife all the time finally one night late June she started in on me we got into Yet another argument she hit me again so I had her arrested. 4 days later they let her go and she came home took my son and left. Within 2 weeks I was servrd with divorce papers and a restraining order on ME! Of all things. I have been the one for the pat 7 years getting hit in the face everything in house thrown at kicked in the groin scratched sockd burnt slaped hi over the head with anything handy. Now that Ive lost that hudge income and could not keep up things became way worse. Of course my heavy drinking to cope with my deppression did not help . But I had been asking for help from her for months . Part time job for her anything.

The morning I was to go for the restraining order final hearing I was taken to the emergancy with what I thought was a heart attack but turned oout to be a respetory problem along with an anxiety attack.

So I missed the hearing and received a default judgment. Only in the temp restraining order my son was not listed in any kind stay away. When I was sevrd the permanent I can no longer see him for 3 years.

Now the divorce hearing is next month and I can no way afford any kind of lawyer.

I want to get a hearing to explain why I was not in court for the hearing And get some things changed but don't no what to do . I trie the family legal help at the court house but they really did not have the time .

1) what forms do I file to get the court to revisit the defult judgment due to medical emergancy

2) what is the best way to prepare for the lies and drama my wife is going to try to pull.
She wants full physical custody as well as legal custody she also said she wants to change his name to her maiden name
She is also sueing for $2900.00 in support

Your game plan is to hire a lawyer. Sorry that you can't afford one... you NEED to figure something out otherwise you are very likely sunk.
