    Removing ex from house
    We have lived together for 4 yrs, house is in both our names but he does not pay for anything except the gas bill. I'm tired of paying for everything and I want him out. What do I have to do to get him out of here and to stop draining me financially.

    If the house is in both names, then he is entitled to half. I would suggest, if you could, buy out his portion and then put the house in your name entirely. Then perhaps you could get rid of him. How does he get to live free and only pay one bill ? Does he buy groceries ?

    First of all I used my money for the downpayment and the mortgage comes out of my account and he does not pay any of it. He does not pay for groceries at all except for when we are out of something he likes. I keep asking him for money but he does not respond. He just leaves.

    What he pays for doesn't matter much, the fact is that the house is in both of your names, therefore it is owned by both of you.

    Best thing to do is to buy him out or sell the house and split the proceeds.

    I don't know what State you are in but in NY you could sue him as part of a request to divide the property. The Court would take the downpayment into consideration when it determines percentages of ownership.

    Some of this will depend on exactly how the property is titled.

    You would then know the dollar amount you need to buy him out - or the dollar amount he needs to buy you out.
