Whatever the amount of sentenced time was "stayed" by the Judge at the time of sentencing. Also, the old case could be added to the new case and sentenced for both of them meaning that the outcome would again be based on the sentencing requirements in your state for whatever the felony(s) and misdeameanor were for...

He could serve the time that was left over from his first felony.. My boyfriend is kind of in the same place.. He has a 1st degree felony and a ticket which is a misdemeanor. He is in jail now and waiting court on the 17th of this month. He could get up to 3 yrs in prison... But I am praying they will give him maybe 30 days and reinstate his probation.

    Hello d:

It's not as simple as that. There are MANY, MANY factors that go into sentencing, and you only presented a few of them... That's OK, though, because even if we knew them all, nobody could tell you what a judge would DO with that information.

What I can tell you is this, whatever is going to happen will be better for you if you have a good attorney.
