    VASAP Violation From Cough Medicine
    I am wondering what can I look forward to for the results of this problem? I was currently enrolled into VASAP and had completed all classes but one last driver awareness class. I had been having trouble with allergies all summer and eventually ended up with an head cold from heat from outside then going in a cool room. I had been taking Nyquil at night and benadryl in the day. I attended my last class and at the breathalyzer test I blew a .03. At that time I was dismissed from the class. I called the VASAP office the next day and let them know what had happened. I was informed that I had to be referred back to court on violation charges. Was also told by my case manager that she would explain to the judge the situation. What am I looking at as far as an outcome for the violation? I was in class for a 2nd DUI that happened almost 4 years ago. Since that time, I had quit drinking with the help of AA. I have all AA records. And all other classes I had a negative reading. I've heard cases of people getting a DUI from over the counter medicines, but I really thought that the other party had maybe had one drink to offset the breathalyzer. I see now that it is true and that you don't have to drink to get an "alcohol reading". I been sober for 9 months now. I am really scared because this was the last class to complete before getting my license back.

    Wow. I am assuming that since you have been sober, that you also have a drinking problem. Alcohol. Nyquil is Alcohol. I think that if you have decided you want what we have, and are willing to go to any lengths, then you are ready to take certain steps. Worry first about that, devote all your time to that, and the rest will come to you. That is our experience.

    You are right. I did have a drinking problem and that's why I chose to attend AA and stay faithful unto the problem. I really wasn't thinking about the alcohol contents in the Nyquil as this is not something that I do on a regular basis (drink Nyquil or any other alcohol-based medication) to continue to have it in my system). I want to remain alcohol-free and have taken certain steps to do so. I have picked up my 9 month chip on Tuesday. But what will the judge think? I know this is where the spiritual part comes into play also. This is where I have to let the God of my understanding work it out for me.

    Nahhh. Keep God out of court and in church where he belongs. What you need, is a good lawyer.

    May I remind you that court has nothing to do with "right" or "fair"? You prattled on about how wonderful you are as though that's going to win the judge over. Well, it might, if you can tell your story in court. But, you probably can't - not effectively anyway. Plus, you're going to have a prosecutor on the other side telling the judge what a liar you are.

    The Judge may have some sympathy for you, seeing as this was a night time cough medicine. However, if you read the label of such things as Nyquil, you would have known and in your counseling and classes, I am sure someone told you what products to stay away from. I know this because this was something I did in counseling sessions with people with alcohol addictions. But now you have learned an important lesson and I bet you will not forget that. Also remember not to eat lemon poppy seed muffins. The poppy seeds with register in your blood. No kidding on that.

    If your casemanager said she would ecplain this to the Judge, that is great. You may get a reprieve or just have to be retested.

    Excon I didn't recall mentioning that I was a wonderful person. All I was trying to do is explain my situation. Neither did I question the fact about what was right or fair. What I was doing by posting was just trying to find out what to expect when I do go back to court. I understand that there will be eye-raising questions on both sides, however, I will have my personal lawyer to look over the case for me. I just need advice as to what the possibilities are for further punishment or winning my case. Let me remind you that God of MY UNDERSTANDING is not with me just in church. He is with me 24 hours a day 7 days a week. Why should I limit him to one day a week?

    Thanks for the input. This was the kind of information I was looking for. And YES I have learned a valuable but possible costly lesson. I will always remember this and the day it happened. I hope the judge understands and if I have to redo all the classes over again, I will do that. I just hoping that I will have the opportunity to do it over if it doesn't get dismissed.

    You're a drunk who drives cars. If you got caught twice, you did it dozens and dozens of times. My children drive on those roads. You clearly didn't give a damn about them! Where was your God then?
