    Unauthorized Charge on card and release of private information to a third party
    I have been out of work due to illenss and my storage unit was in arrears, when I called to see how much I owed I was told the account was current I asked how and she said it was paid for on my credit card, I told the rep that I did not have a credit card and she looked it up and said it was the one used in January.. my daughter had made that payment a one time payment in January and they retained her card number. So they charged almost $550.00 to her card without authorizaion, when I called UHaul the billing rep said "I did that to get your attention" this happened on March 30th, 2007, I had spoken with the same rep on March 22 or 23 and told her I would be in the end of the month. This created a lot of problems as my daughter has of course bills and rent like most people. I found out later in the day my alternate contact which UHaul has to have, the came rep that made the charge called her and told her how much I owed, that it was going to auction if I did not pay and wanted to know if she wanted to pay it! It is my understanding that the only thing a creditor can ask a third party is how to get in contact with me, they are not supposed to reveal any thing like how much owed etc.

    What can I do they have refunded the money finally today, but my daughters rent was late due to this I know it is credit card misuse or fraud and violation of my privacy regarding what information she gave my friend.

    Of course now UHaul is totally ignoring my calls and e-mails... If I don't hear from them by 5:00 my daughter is going down to swear out a warrant for the credit card issue what else can we do?

    First off it is illegal for any creditor to tell anyone about what you owe or what they are going to do to you. Second, Uhaul and almost all rental places are Franchises. Which means the are probably hold harmless for what a lessee does unless you can prove that is authorized or allowed by the corporate structure. Now for the reality part of this. You can try to sue and try to recover your money from the charge
    But I doubt they will say they told anyone anything about you which means your word against theirs. Second I would be willing to bet that the rental place will say they got your daughters permission to charge it since most online or phoneline charges are for onetime purchases unless you give the place permission for a reacurring charge. If you can prove your case, contact the corporate headquarters for the company and deal with customer relations then try contacting an attorney. But keep in mind that attornyes, m unless they are civil litigation do not work on contingencies basis, which mean you will have to pay up front. Good Luck
