    Sooo, A friend has a criminal record going back from 17.. on his 19th birthday party he took the case a beer that the cops had taken away and set on the trunk of the car and he tried to run with it.. he was placed on 6 months probation.. he then breeched probation by taking off rom sask to come to BC without talking to his pro b and then again when he went home to sask and him and a buddy did 6 break and enters.. he went to court for the break and enters and breech and was placed on 1 year probation, restution and 80 community services... so he was on a 1 year probation from Dec 6th 2005 till December 9th 2006... On September 7th 2006 he was cauth stealing a pair of shoes from Zellers... He quoperated with them and he never actually had to say he was guilty and sing any papers but he was issued a Ban from any Hudson bay company in canada... and the cops were brough in.. he paid for the shoes right then in there.. Sometime in Oct he got a letter from the MIller and Thompson law firmt hat deals for Zellers and they were giong to settle with a 500 feee payable to zellers.. My friend consulted a lawyer, him pro be looked into it and he alwo alked to a cop... All said that if he hadent received a summons within a month or 2 then not to worrie about it and the company could not ask for a settlement because he was not charged for it.. so he never paid.. Today he receive a summons to appear in court because he was being charged with theft under 5000..

    Now my question is... Is it the court charging him or is it the company.. and if he would have paid the settlement would he still be chagred with the offence... What is the posible offence that he will be charged with.. is there anyway to help him or what should he do... Or what ? Keep in Mind that he was on probation at time of offence and he is now off probation...

    Theft is a crime against the state not just a person. When prosecuted for theft it's the state vs the alleged thief.

    With his record, I think jail time is in order.
