Theft Under $5000
I was recently charged with theft under $500 dollars. I was at a local store and my friend ask me to steal, me, being the immature idiot I am agreed I would. I stole of total of 50 dollars worth or makeup.
My court date is set for may 2nd and I would do anything to have it erased.
It is my first offence ever, I'm an excellent student, involved in my community and have never been in trouble before.
Can I get out of having a criminal record by paying a fine and doing a lot of community service? Also I have written apology letters to the store and the cops.
Please tell me what you think, I need all the help I can get and I will do anything to get this horrible mistake on my part erased.

And you were how old?
If under 18, relax, your record will disappear when you turn 18.
If you are over 18, go get a lawyer and this being your first offence, he can work it so you don't get a criminal record.
Heck, if you are under 18, get a lawyer now as well.

I'm 19 years old.
Also when we were detained by security he proceeded to call me stupid, told me that he knows I've stolen before( and I actually never have) then he took personal phone calls and told his friends about what had happened.

What if I don't get a lawyer because I cannot afford one and I don't want my parents knowing.
Also I have been reading up about how I can fight this case by myself and I am prepared to due to the studying I have been doing

What is there to fight with? From what you posted your guilty. The mall cop story will mean nada in court. Your best bet is a lawdog to plea it down for you.-- Savage

The mall cop was mean to you? Who cares?
That is what the Judge will say.
You CONFESSED. And if that is not bad enough, you wrote a confession letter to the cops.
You are guilty, if you don't want a criminal record, than strike a plea bargain with the Crown.
You don't want your parents to know? I won't even go there. But parents can be forgiving. You made a mistake, own up to it. If you hide it, are you really that remorseful?
You can always talk with the Crown attorney yourself if you don't want a lawyer.

You can get the Crown Prosecutors number from local phone book. I seriously doubt a prosecutor will bother going forward with charges and will instead opt for Diversion program. Actually, despite you writing a letter of apology to police... charge is still very beatable as most security guards are not fully or adequately versed in enacting a Legal arrest and Search and Seizure, including taking statements from yourself. Anything you said after the fact is irrelevant if the actual arrest is not done correctly. True... Security guards are sometimes "Mean" when making an arrest, but as a result... often their arrests are not legal and your rights may have been violated with respect to "understanding right to council and did you waive your right to council with full knowledge of the consequences and did you waive your rights because you were afraid or felt intimidated by the Security Guard.
Did you ask "do I need a lawyer" when he read you your rights? If he answered you in any way other than to say he could not advise you on this question, then he has likely breached your Charter of Rights and everything after that including the confession is inadmissable and therefor not a legal arrest.

I was charged with thieft over 1,000, to a bonds man to get my boyfriend out of jail I had wrote a bad check on his grandpa for 1400 hundred they closed the check cause I told them the next day, the grandapa is not pressing charges but the bondsman is this is my first offense I'm I looking at jail time
