    Is shoplifting a misdemeanor or larceny?
    I recall that 14 years ago I was charged with a misdemeanor but now I am showing a larceny charge on my record are they the same thing and if so can I get my record esponged.:confused:

    Were you a minor at the time of your arrest? If not, you won't have much luck clearing your record.

    If you were a minor it could be expounged if not you can't. Second it all depends on the amount if the law says a certain amount makes it a felony you have to steal more than that amount to make it so. But Why didn't you check before? Trying to correct something that happened 14 years is going to be almost imp[ossible.

    Each state has it own names for a crime,

    For example in our state, while shoplifting is a crime, it is not the name of the crime, it is basically threft under 1000 ( I think)

    And the amount of items stolen would determine if it is a felony or a misdemeanor

    But result is that it is on your record.

    The term "larceny" just means theft. It's simply stating that the nature of the crime was theft (as opposed to assault or speeding or whatever). What you are concerned about is whether it is a felony, which it is not. So long as the charge was for theft under $1000 (or in some states under $500), it is classified as a misdemeanor

    The only way to straighten this up is to contact a lawyer. There is nothing you can, personally, do about this. And Good Luck with getting it done even with a lawyer, but it is the only shot you have.
    Any one who asked for free legal advice gets what they pay for. I don't intend to sound hateful, but there are so many laws in so many states that it is impossible to get the right advice except from a professional.
