    Probation Violation - Jail Time
    My boyfriend got in trouble a few years back for stealing hundreds of thousands of dollars worth of stuff in Michigan. Since then, he's served his time. He cut 4 months from his sentence for good behavior and getting a job in prison. However, he is on probation for the next 3 years. This year, he moved out to California to work. Actually, he's a really great guy and has stayed out of trouble, with no desire whatsoever to steal.

    Recently, he found out that there was a warrant out for him because he did not respond to some mail that had been sent to his parents' house. To make matters worse, there had a mix-up on report dates because of his idiot of a lawyer. He technically was supposed to stay in MI, but he got away with it because he had been flying back to report every month, like he was supposed to. After speaking to his lawyer, they decided to admit to the judge that he had been living in CA, but for a good reason (work) and as a law-abiding citizen. I know that he was to appear in court to consider transferring probation to CA, and to address his failure to report.

    Then, I find out he's being held in jail because of it and isn't set to be released for another week! Even then, I hear he's expected to be freed, but even that is not for sure. He cannot e-mail or make phone calls, so I heard about this through word of mouth. I am very nervous because I don't even know when he is going to get out, why he's there, what's going to happen to him, or if he'll even be able to return to CA. If someone could please answer me and tell me the likely scenario or what is going on, I'd appreciate it! I am so worried. How long are they allowed to keep him?

    He violated probation so he can be forced to serve his original sentence. He received probation instead of jail time, didn't live up to the terms.

    The wording of your post concerned me - there was a warrant out for him because his "idiot of an Attorney" caused a mix up in the Court dates? How about the part where he was not allowed to leave the State ("technically" he was to stay in Michigan) and did, anyway, but he "got away with it" for some time - ?

    He knowingly and willingly violated. That's not what good guys and law abiding citizens do.

    Sorry - I'm sure you don't want to hear this.

    He violated his probation by leaving the state and living elsewhere. The original judge will revisit his case at his probation violation hearing and sentence him accordingly.
