Less than 2 months left for DUI probation to end, then I got a MIP citation
Less than 2 months left for 1st DUI probation to end, then I got a MIP citation NOT ARRESTED

Will my probation officer find out before the court date?
If they do what will happen if I tell my PO? I know it's a probation violation but what will I get?
And if I do tell my PO, do I have to call immediately or at the next appointment?

If I get some jail time, do they lock me up, or will they give me a schedule of hours to serve. Also, since I'm still in school, am I allowed to serve during the weekends?

Also is it a good idea to extend my court date until my probation is over?
If so, how can I extend my court date?

I know I made a mistake, I was at the wrong place at the wrong time with the wrong group of people. I'm 20 years old, in college, and this is my second year, and going to jail could be very critical for me and my family. Is there a way to get an extended probation or does it depend on my PO's decision.

    Please someone help me!
I am very paranoid, and depressed since the incident and I know I should be
I have no idea what to do, and I need some experienced instructions of what I should do to prepare for my sentences. Knowing more about my situation before facing anything on my own will probably help me and give me some room to breathe.
I know what I did was wrong and I regret it very much.
Im not trying to get away from my wrong doings, but rather trying to reduce the possibilities of maximum sentence, so I could move on, and try to make things right.
I'm very sincere about this so please someone help me

The MIP is a violation, you not notifing him is another violation, Most likely ( but one never knows) but my quess is , since you were not driving they will not do anything in reference to your DUI if you go and tell them and explain it. IF you don't report it, ( and yes if he merely pulls up your NCIC report, the citation will show up) so if you don't tell them, that really just makes them so mad, they will try to make your life hell if possible to teach you a lesson. ** at least most of the PO I have know though the years.

And it is not being found guilty that gets you in trouble it is just the ticket to start with. You can be found not guilty and they still violate your probation for the MIP ticket, and esp for not notifing them.

I doubt there is any jail time, perhaps stricter supervision, up to including weekly urine tests and the such.

So if you want to do it right, go in and see the PO and tell them about the MIP. Also have an attorney at the MIP, most times you can get off with some community service and have the case dismissed with an attorney

    Thanks

I talked to my lawyer, well not the lawyer but his secretary or what not, over the phone
And he is telling me that I don't have to tell the PO
And that I should keep quiet, because I haven't been to court yet which is totally different from your opinion

Also, this is the attorney I paid for my DUI case a year ago, but they really didn't do much

Are they trying to make money and put me in trouble?

Or should I get a different lawyer

Or don't even bother getting a lawyer and just tell the PO what happened?

Also when I was given a citation, my license was suspended so they didn't write my license number down...
Would my PO have harder time looking for my citation without my license number?

    1. You do need an attorney.
    2. I don't know the exact terms of your probation without reading your probation agreement, but with years of being a police officer and even working in the private probation office, merely being ticketed, is a violation of probation in any area I have ever worked. The being arrested or ticketed is all they need to violate probation on any place I have ever worked. Now a busy PO may never catch it, but on the other hand if he does, he will have you not only on the ticket but also for not notifing them.

Since this was a secretary or clerk in an attorney office, they are no better qualified to give legal advice as any of us on here ( except for the couple of registered attorneyes we have on here at times.

I can only tell you what has happened in states where I used to work or know people. In Missouri, Illinois, Tennessee, Georgia I know for sure that merely getting the ticket can violate you, ( normally won't, but could)

So should I get an attorney for POV and the MIP?
Or there's nothing that an attorney really do to avoid POV, if not jail time, meaning I only need him for the MIP?

    Hello p:

Listen to the Padre. He knows...

You need a lawyer for everything. It's all one case - not two.
