    If I have a bench warrant for failure to pay do I need to go to jail

    Do yourself a favor... Hire a lawyer and let them negotiate this on your behalf... you spend more but might get a better deal.

    If you are stopped by the police, you will go to jail. If you hire an attorney, they should make arrangements for you to turn yourself in, post bail and be out in a couple of hours.
