    Hello viola:

Write a letter to the probation officer telling him exactly what you said here. Send a copy to the SUPERVISOR of probation and a copy to the judge. Send your letters certified, return receipt requested.

If you have gotten your answer from the Judge and the supervisor, then I guess your friend will just have to do whatever is required of him. He is after all a convicted felon, ins't he? His health had nothing to do with him committing a crime, so his health should have nothing to do with him complying with the Judge's Orders either. The Judge did give him probation instead of jail, so I guess you should be at least grateful for that small favor. It all depends on what your friend did to acquire the felony conviction. If the community service hours are ordered to be paid by minimum wage, so be it. Apparently the Judge goes strictly by the book. There is only one other alternative for your friend and that would be to hire an expensive attorney to file a motion, have a hearing and then have the Judge decide again to refuse the request or not. Either way I am sure the Judge will win in the end.

In some states even though you are sentenced to serve so many hours doing community service as part of your probation requirements, they still make you PAY for the privilege of doing those hours even if it's $1 per hour to serve the hours as a form of administrative costs of paperwork shuffling.

Yeah, sitting isn't going to hurt him. I've done a few community service hours myself. Most of 'em were sitting.

There are many jobs, even answering phones and other jobs at homeess shelters that can be arranged. Sometimes if you show the non profit group the medical they may just let them come in and sit.

Ex - No, they want HIM to pay the minimum wage to get out of doing his community service hours. Chances are slim and none that they're going to pay him to do his hours. I think you misread the poster on this statement.

I am sure a job can be found somewhere where there is little physical effort involved. He needs to ask the peoeple at the probation office to help hook him up with the people doing the community hours programs. Sounds like hubby has a bad case of lazyitis to me. I side with the Judge on this one. There is no excuse that he cannot do 600 hours. For 600 hours to have been imposed I am sure he did something that warranted this type of "punishment". Judges don't just arbitrarily hand out 600 hours because they woke up one day and decided to hand out such high number of hours of community service along with probation. Would suggest hubby get with the program as soon as possible or the Judge will be worse than upset when he finds out no hours have been completed and the time for his probation coming to an end and he is in violation of his probation due to noncompliance in performing his community service hours that were imposed as part of his sentencing.
