    How do you return home if you are senenced to probation in another state?
    My husband was convicted of felony theft in the state of Texas (with differed adjudication). He has moved to Missouri with me and has a job in this state. He went to Texas for sentencing and they gave him probation. His probation officer told him that he cannot leave the state until Missouri (the receiving state approves him). Something doesn't seem right from what I have read on the interstate compact website he should at least be allowed a seven day pass.:confused: If he can't go to work he will lose his job and then he would be violating the conditions of his probation... Right?

    Hello k:

    He can be given permission to travel. If the PO is denying that, he can certainly speak with his supervisor.

    That is what I thought bu they said to him that because off the class of felony that Missouri had to accept him first... I think I will have him call his supervisor tomorrow! Thanks now I don't feel like such an idiot!

    If he asked permission to move, yes he has to put in a application and be approved, With a 7 day pass he will have to return after 7 days, it can take weeks to get a transfer approved.

    SO... I talked with the MO probation officer today and he said that my husband needs to report to him as his probation has been accepted, I told him the situation again and he recommended that I contact the TX interstate compact. Did that.. They say that everything is done on their end and they are waiting to hear back from Hayes county so I called them and they said that they haven't heard anything from interstate who also told me that by law my husband has the right to come home as he resides and works in this state and lived here at the time of his sentencing. The probation officer lets his assistant handle everything and she is very pretentious! She told me that they do not have to issue him and will not issue him a travel permit. So basically my husband has lost a VERY good paying job (violation) and missed his first probation appointment (violation) thanks to the state of Texas!! Hopefully his probation officer won't violate him but they are FORCING him to break rules... I am so frustrated with this... Not to mention that he has a $600 restitution payment due and hasn't been "granted" permission by the state he owes to return back to work... what do they want him to do? Go steal something? What a disgrace to our judicial system!
