    How do I ask the judge to drop a probation violation in OREGON State?
    Hello,

    1st county is Clackamas County, Oregon... 2nd county is Clark County, WA

    My boyfriend is in a sticky situation. He was released from county jail (1) in August 2011. He reported the next day to his PO like he was supposed to. They told him to report again in a week. He admitted to his PO that an abuse of some form happened while he was incarcerated (not going to say what since it's an ongoing investigation) and that he was high and that he had no where to live and asked her what to do. She dismissed his concerns and moved on. He never reported again. He went on a downward spiral of depression and ended up getting arrested again. This time, in another state (2). His probation officer submitted probation violations to the courts and warrants were signed by a judge and released in September and October of 2011. He was arrested in October 2011 on new charges in another state (2). He sat in county jail for almost 8 months waiting to be brought up on his POV charges. He had asked to take care of it before being sentenced to prison. They never did. Now that he is sentenced and doing over 2 years, he has security holds from this county (1) preventing him from being able to do any type of program except for NA and his GED. He wrote into his original PO, the PO that took over the case and their supervisor to see if they would be willing to work with him. He got a pretty nasty letter back from the supervisor stating that they will not recommend that the warrants be quashed and that they will recommend his original sentence be imposed.

    We need to know where to go from here. Motion the court? Write the judge? Wait it out?

    I am starting to pay on his fines and I have tried to keep in touch with his PO's about his progress. They don't seem to care but I do it anyway. He has written in at least once a month since being arrested in Oct. to see what was happening with his case. They never wrote back except for that last letter.

    Any help is appreciated. Thank you.

    Hello pixie:

    There's only one thing to do.. Hire a lawyer that familiar with probation problems..

    You want Oregon to drop its charges but you don't really have any grounds for it except that you'd like them to do it.. Well, the courts don't work that way. That might be why you/he got the nasty letter he did.

    Yeah, a lawyer is going to be expensive.. How much does being in jail cost him?
