I have a warrant for probation revocation what are my options?
I have a warrant out for my arrest. Back in 2006 I was sentenced to 5yrs deferred adjudication probation for a control substance. I then violated in 2007 and did 30days jail therapy. Fast forward a few years. I was due to get off Nov 2011 but I had some health problems and turned to drugs which caused a seris of dirty UA's. I went to court and after I did my UA I came back and the court probation officer pulled me to the side and said that I had Zantax. I know I hadn't been taking them but I was taking some antibiotics that were not prescribed to me to fight off some of the infection. He then said well that is a violation itself. So I ran. I called and I do have a warrant. They have my address and my work address but I am scared that they will come get me from the hospital after I have my baby which is due on the 14th of NOV. I would like to go into treatment if I could take both my kids but at this point I don't think it is an option. I am currently on welfare so I can not afford a lawyer and any extra money I get goes on my meds for my HIV. PLEASE LET ME KNOW.

You are not allowed to take your children with you into any drug treatment center in my area - perhaps if you tell us where you are someone has more local info.

Warrants never die. You can either turn yourself in or wait until you are picked up. If you turn yourself in, you pick when. If you let the Police come and get you your kids COULD go into foster care until other arrangements are made.

Turn yourself in and request a Court-appointed Attorney.

Were you using during this pregnancy? I can't figure out the time frame here.

Also, somebody "slipped" you Zantax and said it's an antibiotic? It's over the counter. I don't know why it would show up on a drug screen, don't know the terms of your probation, don't know how you got it. You thought it was a prescription?

At this point you have a warrant, so after the baby is born, you will need to arrange care for them, and turn yourself in.
Get a court appointed attorney at that point and try to prove that you were not taking any illegal drugs ( your attorney will find out what drugs showed up)

Then you hope the judge will give you an additional chance on probation again.

With this type of history when you get before the Judge again I seriously doubt he's going to give you probation again as you obviously can't stay out of trouble or away from drugs. You need to make some serious arrangements for your children to be taken care of while you are "away" for awhile in jail. You could also be picked up at any time (and not just while you are in the hospital giving birth) and could end up in jail and give birth there.

If they know where you live and where you work they can come for you at any time.

You need to seriously reread your original sentencing paperwork to see just what your Judge had in mind when he originally sentenced you to see what sort of punishment he will give you should you violate your probation. You could end up in jail/prison for a few years depending on what his thinking was at the time of your original sentencing.
