    Getting sued from a car wreck
    Hi,
    This is short of a long and confusing story.
    Last year around September I was driving home from work. I have been driving since I was 15. I am 18 now. The job I am at I have been working there since August 2008. I work 4 p.m. to 11 p.m. 5 days out of the week. Anyway, like I was saying, I am driving home from work and the speed limit was 55mph. But on the curvy roads here I always go about 45-50. Well, there was a car in front of me. Jeep liberty. The jeep was swerving all over the road. I was about to honk but I didn't. I figured they were either drunk or not paying attention. So I backed off some. I was about 4 car lengths away. Well the jeep is still swerving and goes into the other lane. There was a car in the other lane. The jeep swung back into the right lane into the right shoulder and was throwing up gravels. I slammed my breaks, sliding on the gravels. The jeep then all of a sudden rammed almost head first into the right guardrail. My car still sliding, bumped the back tire that hooked on the back(trunk) of the jeep. Putting a dent in my car. I got out and the person in the jeep got out. Turns out it was a girl 16-17 yrs old. Driving by herself. I called 911. The police came right after my parents came and the girls mom. Thankfully my cousins lived right across the street. When the police came he asked what happened and I told him. The girl said she didn't know what happened. But my dad looked and noticed that a play list was pulled up on a computer screen in the jeep. Well, the girl said she didn't have her license because it "flew". So after that was said and done, we pushed my car into my cousins yard (the battery got killed), the police report came in a few days later and said that the fault was undecided. Well, the girl and her mom thought it was a smart idea to go and sue my insurance company saying it was my fault and my moms because the car was in her name. Even though it may be, I pay the insurance every month. The girl and her mom of course, lost and now they are coming after me and my mom saying I wasn't suitable to drive and that I am inexperienced and that it was my moms fault because she let me drive knowing I wasn't able to. Everything is messed up. I have to meet my lawyer next Tuesday. Thankfully the insurance company hired one for us, even though we have enough money to pay for one. And if we lose then they are also going to pay for it. The court date is in September and the girl and mom are praying to the jury that they will find me guilty. Honestly, I don't lie about things like this. And what they are doing is wrong. I don't know what to do. Does anyone have advice?

    Oh and another thing. We are being sued for $30,000. And the girl is claiming that she has head injuries.

    Hello b:

    You won't be found "guilty". If you lose, your insurance company pays. That's all. No big deal.

    Yes I know. But after everything is done, whether we win or lose my mom is counter sueing

    Hi Bob, to me it is a big deal, just make sure that you have all the evidence and witnesses if there were any. If you lose, it is a big deal, because your insurance premium will go up! And in your record will say that you got an accident and it was your fault, and that is never goo signs for insurance companies in the future for you! So, if it was me, I would hire the best of the best lawyer in your county. They would help you out a lot! I hope this help. If there any questions, do not hesitate to ask. GOOD LUCK

    Also next time, if this happens again in the street where you are going home or going somewhere, when you see this, you should get the license plate numbers and stop where you are, and call 911 immediately, to prevent whatever has happened to you.

    Thank you luckystar4um,
    They tried to sue the insurance company and lost. And the insurance company hired us a lawyer. And if we do happen to lose then they are paying for it too.

    Oh, I do not get it Bobbalina, how come they lost already, and you still in the case? Are they now trying to sue you guys? Please make it clear? Thanks

    The girl and her mom tried to sue my insurance company. And they lost to them. Now the girl and her mom are after me & my mom.

    What state did this occur in? In NYS you are required to maintain control over your vehicle at all times. My dtr recently got into such an incident. She was negotiating a hiway on ramp in snow and skidded bouncing off one guardrail and rotating backing into the other guardail. Another car came along and hit her. The other car's insurer claims she was at fault because she lost control of the car. Our insurer settled for 75/25 (my dtr having 75). So, if you can show that she spun into the guardrail and you couldn't stop in time so you hit her. I would say you have a good chance of winning. Since your insurer is providing an attorney, just let the attorney handle it.
