My husband's former employer told the unemployment office that there was a warrant out for my husband's arrest saying they had taped evidence of his crime. A month after he quit, a prospective employer ran a background check and there were no warrants on his record then.

My question is two fold.

1) How do I (we) check to see if there really is a warrant out for his arrest? Do we call the local police for his place of business, the county sheriff, or the magistrate's office?

2) What is the law regarding what exactly a former employer may tell a prospective employer during a reference check?

We need a quick answer to both questions because he has been trying for 3 months to get a new job and can't. He had one almost wrapped up when they ran the background check and checked his references and suddenly withdrew their offer of employment. We suspect it is his former employer at work again. We did ask them why they chose not to offer employment but never got an answer back. The people who ran the background check even told my husband that he has an excellent background!

If you're just an average American family, the cops don't put out warrants... They put out warrants for people they can't find. If there was a crime committed, they'll come visit, and if your hubby is a suspect, they'll just arrest him. They WON'T put out a warrant and wait around.

Besides, warrants for arrest would NOT show up on a background check...

IF the previous employer is LYING about your husband, and it costs him work, and you can PROVE it, you can sue for slander...
