    Wrongful charges on credit card
    Okay I have a question, I was at a restaurant last Saturday and I spent about $80 and I kept looking throughout the week to see when it was going to be taken out of my account. Well I got a call today which is Friday, nearly a week later saying that they didn't swipe my card and they were going to swipe it today for a balance of $214 plus 11% gratuity. I did not spend near that amount of money. I called and canceled my card before it was taken out. And I tried to call the number back and it came from some medical center. So I'm thinking that the girl that was my waitress forgot to swipe it and knew she was going back in tonight and was going to do it then. Is that legal? A week later? And for way more than I spent! This just does not make sense to me!

    Did you not get a receipt? I would go to the restaurant and show the receipt!

    I didn't get a receipt, I accidentally walked out without signing it. I had done this in the past and they just ran it through that night with the exact amount I spent. They didn't run this one through that night or Monday, tues, wed, thurs, and I get a call today with a ridiculous amount which is way more than I spent, other people had to be putting stuff on my tab without me being aware of it.

    At this point since you didn't get a receipt it would be hard to prove you didn't spend $214.00 there, if they are trying to scam you out of some money your kind of screwed cause they can make up a receipt for any amount now that they have your card #.

    Another case of buyer beware...

    I'm not positive, but I thought that a charge was not valid without a signature if it was over 50 bucks. It doesn't seem right to me, but I'm not an expert on this... im sure someone will come along with a good answer soon. Good luck.

    Okay, I cancelled my card before the charge actually went on there. I think the lady was leading that she was going to run my card # through when she went in tonight. Will that be processed with a canceled card? That doesn't make sense to me.

    Cancelling the card was probably a bad idea, they can't charge you the 214.00 but they also can't charge you the correct amount (or the amount your assuming is correct) so they'll probably end up sending you a letter demanding the payment or giving it to a collection agency.

    Try calling the manager and explaining that your bill was around 80.00 (if the waitress told you the total give him her name) and explain you temporarily cancelled the card because you did not spend 214.00 there. Also bring up that it appears she never ran your card.

    If the manager is in any way decent he will look into it. Do you actually have the card itself or do they have it?

    I have the card. It was one of those deals where they put the info in the computer and then swipe it at the end of the night. But for some reason they didn't swipe it. I probably did cancel my card because I was thinking irrationally but I don't even have 214 dollars in my account and I sure as heck didn't want too lose what little I had left in there to something that I didn't even charge. All of my friends bills were extremely low so I'm wondering if somehow there items were put on my tab. They haven't taken the money out, and I'm still trying to figure out how they got my cell phone number to call me in the first place. When I called the number back it was to a medical center that didn't even have anything to do with the place I went too, which I found to be very odd.

    Call your credit card company They will help you. It does sounds like someone has your c.c # and is scamming you so I would personally go back to the place you were at and speak to the manager. Check with your friends and see if they can prove their charges even take their statements in just in case they are charging you for everything and every body. If the charge does show up on our bill you can dispute the charges they take this claim very seriously so do the retailers it does hurt them and they are charged a fee if the money is taken back out of their account. You do have a bit of power with a credit card.
