Levy on Bank account/ judgement on credit report
On week before christmas of last year I called to check my bank account and was told by the bank that I have a levy on my account, I asked them how is it possible that a stranger that I have never spoken to can do this to my account. The bank gave me a number and said that Thomas Law office put the levy on my account. I called Thomas Law office and asked what is this in reference to and they redirected me to Calvary Porfolio Collection Agency, they stated that I owed a phone bill from the year 2000. I asked them how can they make a judgement without contacting me. They stated that they tried to reach me but couldn't. I asked them when was the court date in which I was suppose to appear, there was'nt one. My question is if I wanted to dispute the bill what can I do, also this account is showing as a judgement on my credit. I never knew they were trying to reach.

You should have gotten the docket number and court from the writ of attachment served on the bank. You then contact the court and file a Motion to Vacate on the grounds of improper service.

If they can't prove proper service then you can get the judgement vacated and the levy released. However, they will properly serve you before you leave the court. But at least you can now fight it or negotiate a settlement.
