Being sued by credit card collector
I recently settled w/a credit card collector (law firm) on a credit card that I supposedly owed over 8000.00 I settled w/them for $5000.00 and they accepted and sent me a letter indicating that they would remove from their books and would not collect any longer.

This was in Oct 2006 and in Dec I start rec a calls from another law firm trying to collect on same debt I told them I had already settled and faxed them the letters confirming this. Thought all was taken care of and then Jan 2008 I was served a suit for the remanning balance of this debt. Can this be done after the other law firm agreed to the settlement and closed their books on it.

I wa served court papers for March 14,2008. This is on a credit card debt.I do owe the bill but I have no Job or income coming in at this time. I have a 401 K but I can not get it until after May. Will I still have to go to the courts or can I write to the attonery and explain to him what my situation is? What do I do? They sent a answer sheet. But I don't know if I have to fill it out or what?
    Thank you,

Anyone can sue you for any reason.

Winning the suit is another story.

If you need to answer to the suit, be sure to do so in writing, via certified mail with signature required on delivery so you can prove you answered.

Then, take all the documents you have to court and present them as your defense.

If things are as you say, and the documents indicate this settlement, you don't have anything to worry about.

    Good luck!
