    Severance Pay
    My former employer has defaulted on our signed severance agreement by having insufficient funds for my severance check to clear. In other words, my severance check bounced. I have notified the District Attorney's office and the Department of Labor. Can I file a summons and complaint and have him served?

    I don't think you should go so far as to have him served yet. You have done all the proper procedures so far. If you had a good working relationship with the Company, I think you should give them a grace period to see what they come up with and keep in touch with the Board of Labor.

    Hello h:

    The DA might prosecute him criminally and the Department of Labor might write him a letter. Neither of those will get you your money. With a judgment from the small claims court, however, you can get your money. Plus, that'll get you a summons and complaint to file.

    yes = you just want your money and by forcing the issue you could end up with nothing, give it a little time - follow up personlly without lawyers - the moment your say sue is the minute they stop listening to you
