Is it new in the box, no programs in it but have to be added by disk when you get home. And again what type of store, if you are buying it from some place that makes you ask that question, then that is not a place to shop

If it is new, in a box, there will be a tamper proof seal on the box.
If that seal has been broken, you can tell, and avoid the purchase of anything that has the seal broken.
Many new computers come pre-loaded and do not require the retailer to install anything, so don't let the salesman tell you that they had to install something, and that is why the box has been opened.
Also, use a well known, reputable retailer, such as Best Buy, or one of the office supply stores like Office Max or Office Depot, or really, any well known retailer in your area.

There is a big difference between brand new and secondhand. If it looks brand spanky new out of the box including the warranty card, you should be fine.
Examine the item yourelf. Pay particular attention to the keyboard and what you can see in the crevices around the keys. A used laptop takes on a "used" appearance pretty rapidly.
Anyway, your eyes are your best bet on this. Have them let you unpack the item in the store with their service person watching.
BTW, I love to purchase and frequently DO purchase "refurbished" equipment. It is a HUGE $$ savings on an item that has seen little use, was taken in, whatever was originally wrong with anything has been fixed and now it's being sold AGAIN at a discount.
Think about it, someone else found the problem, it got fixed, and now you're effectively getting a new laptop at 30% off and it's had the bugs worked out FOR you. Other people's mileage may vary, but the last 3 laptops and 1 desktop I purchased were intentionally purchased with a "refurbished" flag on them.

And I will say there are some "rent to own" places that resell computers they pick up as new, I know one who did this all the time, since they put it out on the counter and want you to buy "that one"
If it is not in the box sealed, I would expect a discount right then, I would look at the keys for use, a little dirt in the cracks and speaker openings. I have bought several used computers, some off eBay, but escept for eBay always from places that work on them, and have warranties that include onsite for desk models.

The laws vary from state to state on new vs. used in the rental purchase industry.
In the three states I have experience with this industry, it is illegal to sell a "used" item and represent it as new.
The Rental Agreements are required to be marked to indicate "new" or 'used" at the time of rental.
JB & FC both make excellent points, especially looking at the keyboard, and the mouse pad on a laptop, they develop a "shine" in the areas that are used most often, such as the space bar, and the commonly used keys. You can even compare the A and the E keys to the Q or Z keys and see a noticeable difference.
