Took my children out of state.
Dear all who that may read this,
I am 22 Year old father of 3 from Wisconsin. I have two wonderful twin girls, and a baby boy they are 3 now. I need some help figuring out what I can do as a parent to stop this from happening.
I have joint custody of my Daughters and have visitation rights ,I pay child support. I have not been getting my visitations, I have tried but either she ignores my calls, she leaves at my visitation times. This has been going on for about 5 months now and I have had enough. She pushed me over the edge this time.
I just recently found out about her going to Florida with my children, she has been there about a month now. She hasn't told me anything about it accept that they are in Florida and I am in Wisconsin. I need to know is it legal for her to do that? Is that criminal? Any help would be great...
I have a phone number to a place in Florida but no address... PLEASE HELP WHAT CAN I DO?

Hello,
You have two separate issues, if you are not getting your visitation, you file a complaint with the court and try to get them to order her to allow it.
If in your divorce it stated she could not move out of state without court permission, she is in contempt, you file a complaint on that also

She can take them out of state if they're only on vacation, if they've moved there, then that's illegal, it's kidnapping. I would file a complaint with the court. Then she'll have to come to court and explain what's going on. And maybe if she sees that you're serious, she'll be smart enough to bring your kids back. Kidnapping is a serious charge, I don't think she'll want that.

If you have legal joint custody then I doubt that it's legal for her to move to Florida without your consent. You should review your court order to see exactly what it says. Talking to a lawyer will help also. If it turns out that she violated any provision of the court order then your best bet will be to bring her up on charges, ask the court to find her in contempt and issue a warrant for her arrest. Actually, you already have one ace in the hole because she's denied you visitation which had been previously ordered by the court. Use that as your starting point.
