    How to Evict an Adult Child in NYS
    I live in NY State and have a grown 24 year old son who lives at home,(recently laid off after first job out of college a year ago) and he lives with my wife and 7 year old granddaughter
    (his niece). He has worn out his welcome by continually challenging and insulting his mom and I and endlessly teasing and harassing the 7 year old granddaughter who is also being treated for mental illness (My older son died 4 years ago and the daughter is a product of cocaine and drug abuse).

    Question is.. This kid has never paid rent because we were trying to help him while in college and while he got first job, but his continued criticism of my wife and I and granddaughter has grown thin and I want him OUT , NOW...
    Has anyone out there gone through similar experiences? Do I have a leg to stand on... Please don't respond with comments like grow a backbone, unless you;ve been in my shoes.

    You have to go through eviction procedure.
    Give him a written notice probably 15 days depending on your state law. If he doesn't leave by the 15th day you go to small claims court and file for them to send another 15 day notice of eviction. If he still hasn't left by then the sheriff comes and escorts him out.

    If it is more or less days I am sure someone will reply with your states law on how many days.

    I feel for you! Hang in there! I would follow the above advise. I just got off the phone with the police myslf. I have an 18 yr old son who abuse alcohol and pot. I'm at my wits the officer told me to go get an eviction notice. In the mean time if there is any drinking or pot smoking to call the police and they can take he to detox! Good luck!

    Can they take someone straight to detox against their will? I know many get out of jail by agreeing to rehab

    That's always a hard position to be in as a parent. I'm sorry you are even in this position. Draw up the paperwork for an eviction notice and put him on warning,( If you don't want to kick him out right away). Tape the thing to his door and tell him the first time he breaks your household rules you are putting a date on it. Otherwise, I wish you good luck, sometimes taking a firm stance on a decision like this is really the best decision you can make for your child. Good Luck!

    The police officer said yes, if drunk they will take them straight to detox! Yes even if they don't want to -there a danger to themselves and others.
