    Father's name on birth certificate
    If the parents are unmarried, does the father need to be present for the mother to put his name on the birth certificate?:confused: :confused:

    No he does not need to be present. Just write his name on the line.

    I know in some states if not all the father and the mother must sign an agreement of paternity. If he does not sign this paper he is not legally the father until you file a petition to establish paternity and DNA testing is done by courts order. I know this because I am pregnant and my health care provider has informed me of this law. Forgive me if I do not have all my terms correct this is solely out of memory . Are you worried he will not sign?

    Nah, I was just wondering because my first son's dad and I had to notorize something there at the hospital. This loser has nothing to do with this child. But I am going to file for child support, so I wondered if he had to be present. I will be having this child at another state, I thought the notorizing thing was only in one state. Thanks!

    A paternity test is the only way to go. Stating a name on the birth certificate is not proof enough to establish who the father is. I live in Illinois and I did not have to have it notarized. I just put his name down and that was that. Most likely, when you file for child support, the court will order a paternity test and then there is no way that he will not have to fulfill his obligations. As always, contact a lawyer in your state to make sure that all of this is true and accurate.
