    Divorced and need to move out of state
    What to know what my rights are, I’m divorced (state of ga) and have three children. I joint legal custody with me being the primary custodial parent. It also says in the divorce decree that if we can not come to an agreement that I have the final decision making power. I'm engaged to be married and my fiancé is a polit. We might need to relocate out of state because of his job. I need to know if I need to file anything with the court or just notify my ex so we can make some other visitation arrangement.

    If visitation was court ordered, then any modification of the agreement has to be done with the approval of the court. Custody has to do with decisiion made on raising the child. Its visitation that is of issue here. You CANNOT move without your ex-husband's AND a judge's permission if moving meant your ex-husband couldn't get the same visitation the court ordered.

    So I would speak to the ex first and see if he is willing to have the visitation modified. Then you can work out a new agreement and ask the judge to ratify it.
