    About a hospital sending my daughter hoe with broken arm...
    My daughter hurt her arm so I took her the hospital, they xrayed her and two doctors told me and her dad she was fine, her arm was not broke. 4 days later I get a phone call of the hospital telling me they had got it wrong, she had broke her arm and to go back in to get a cast put on... my daughter was only 21months old at the time and was in extream pain, I want to know if she is entitled to compentation.

    If she was injured in some way by the delay, yes, you have an action. Has the delay caused this to become a permanent disability of some sort?

    Certainly her pain and suffering are compensible if you can prove that the Physicians were somehow incompetent AND if she had more pain and suffering than if the arm had been "casted" immediately.

    You would need a medical professional to testify that this was incompetence on the part of the Doctors and that is hard to get.

    You can always ask for financial consideration... but I doubt you will get it.

    Errors, unfortunately, happen all too often.

    How is your daughter now? How did she break her arm?
