    Wages being garnished for 15yrs old judgment
    I have been looking on this site and I'm amazed at how many other seen to be having the same trouble. I counted at least 5 post just on this page who are having to deal with old debts. I think my has most of them beat since it's org file date was from 1992.
    Well this is my situation and my question as well. I was served wage garnishment papers last month on a debt from 1992 and the debt was for about three thousand dollars. I was married in 1992 and this just happen to be the same year he walked out on me and 2yrs daughter. So this debt maybe my Ex-husband's and I know that since we were married at the time of judgment I would be responsible for this debt.
    I have been trying to have this debt validated, because I have not idea what it is for. The response from them has been they don't have to tell me anything and since it's been 15yrs no proof is needed for the org.judgment. I'm confused,so in a nut shell they can take my wages and don't have to tell me a thing I did see on these garnishment paper a renewal was granted in 2002. This was done so that the statute of limitations didn't run out.This was all done without my knowing , so I had no way to fight it.
    What I need to know is what are my rights ,because I feel I don't really have any.
    I don't want this post to seem as if I'm trying to get out of this debt I just want to know for sure it's mine.
    I know I need to get an attorny for some advise, but this has been hard for me to do. I'm not taking home much after the garnishment. Well any information at this point would be great.

    They got a judgement sometime, you should have been served court papers at some point in the 90's. The extension in 2002 was just extending the original judgement. You will have to go to that court and pull the records form the original judgement.

    FR Chuck is correct go to the court and request copy of this case. IF the judgment was renew, than File Motion to Quash the garnihsment, lack of proper service. THis will start a hearing on this matter. If it was not renewed File Motion to Dimiss, expired order.
