    Taxes for forgiven debt and Bankruptcy
    This past year I settled with 2 credit card companys. I have received a 1099-C from one of the cards with the amount canceled reported to IRS. I am about to file Chapter 13 can these be put in the 13 with out me having to do a tax return on them?

    Also I would like to know if I can list them as a creditor and this cover the 1099-C.

    I have heard that the card company had to return the amount settled for and it be divided amoug creditors.

    Would some of you that have the knowledge here please help me. I Thank You So Much... there are some very intellengent people on this service.

    When you file Chapter 13, list all of your creditors. Sometimes, one must be careful whether to file a tax return before or after the bankruptcy petition.

Some creditors who are paid within so many days of the bankruptcy filing are considered 'preferences', and they can be made to turnover to the Trustee money received from the debtor.
