    No, but in my state, the lender must send a notice or letter, demanding payment in full, advising of the borrower's right to public or private sale; failure to do so results in forfeiture of right to sue for deficiency balance after the sale.

    No, you would have been previously notified that you are in default and that repossession is an option.
