Can I file bankruptcy on a judgement?
Hi, I have a debt judgement filed in 2002, however I did not know about it till 2006 when my job was garnished. I asked an attorney and was told vacating it would be difficult as the judgement was older than 3 years. I quit my job and moved, now I have received an interrogetory(?) and I have to tell them where I work and how much I make pluss lots of other weird questions. The judgement is now at close to $28000.00 (crazy) and I am already stuggeling with legit creditcard debts close to $12000. I am in the middle of a not so pretty separation and have little or no money... I have 2 children. I own my car otherwise I have nothing else. Can I file bankruptcy on the judgement only or must I include all, wouldn't my creditcard holders raise my interest once they see a bankruptcy. Also everyone I talk to tell me it's crazy to file bankruptcy for less than $100,000.00... but when you have no money the dollar amount means nothing... Help!

No... not usually, most court ordered judgements are not dischargible via bankruptcy laws for this very reason. Everyone that had one would file backrupcy to dodge them.

Sorry to hear about the situation you are in... but you can thank the less responsible people out there for it. Most laws exist as a result in someone previously taking advantage of a situation to get around something. Sometimes it effects those who are genuienly between a rock and a hard place.
