I have been contacted by general reveue corporation,a colllection agency in cinncinnati, ohio concerning past due student loans made to me by sallie mae. They have threatened to garnish my ssdi payments. They sent a contract for me to fill out allowing them to directly deduct an amount from my bank account each month. The day i received this correspondence, i also received a call from them. I tried to discuss making an arrangement requiiring a smaller monthly payment that i could afford,at which point their representative threaten to garnish 25% of my monthly ssdi payment and hung up on me. At this time i called them back and was put through to a supervisor. I explained what happened and was told they would garnish if i didn't pay the amount demanded in the contract they sent me. Can they garnish my ssdi payments without going to court or allowing due recourse to try to work out a manageable way to pay this bill.

Yes they can and will do this. SSDI only protects you from creditors like car loans, home loans. Student debt is NOT one of these things that can be "forgiven" by the disability status. Sorry. You will owe them for the student loans as they were underwritten by the government and the government wants repaid. The same thing applies if you are on Social Security Retirement. Those monthly benefits can be garnished by the government as well.

And no, you cannot have your student loans discharged in ANY kind of a bankruptcy filing either so don't bother wasting your time looking into that either.

Just figure out how to live on whatever money is left to you after the government takes their monthly repayment.

And they don't HAVE to take you to court to garnish your SSDI either. You've already signed paperwork when you took out the student loan to give them the right to garnish your wages, benefits, etc for the loan repayment.

Yes I have just started getting my disability they can take a percent however I contacted the lcs that had my loan and they qualified me for the Wilson program which they will sale my loan to the government and I will receive a payment book they said it will be $20.00 a month. However even thou I signed all the paper work and mailed it back 3 weeks ago the government moving at it's slow pace to process they will take out of 1 or 2 months. I am new at this myself. Hope this helps oh and the percent they are taking is 15%.
