I recenlty tried to get a volunteer position at the Department of Health & Human Services for the County in California. Clearing Livescan is required for any position in the department. They got back to me saying I was rejected due to a record that showed up almost 20 years ago now, that should have been sealed. It was a misdemeanor.

So my question is, are county agencies exempt from California Law only revealing records within the last 10 years?

They said my record had to be clean since birth.

They can probably set their own standard. Most state laws are a minimum standard. They can do more but not less. The company I worked for before retirement required a 5 yr. MVR although almost everyone else used a 3 year.

As ma0641 states... they get to set their own standards... you misunderstand what sealed actually means... it doesn't mean it never happened. It never goes away... certain types of checks will always turn things up... while a few won't.

And certain types of convictions will forever bar you from certain job fields.
