Greetings.

Due to familial / legal obligations, I need to be overseas for 8 weeks (July and August). I outlined my request to my Manager, with details. My manager has come back and stated that she is only able to provide me with 5 weeks leave. While I appreciate the offer and the consideration of my requestion, I do require the full 8 weeks. As a result, I have to resign.

My question is this... I am willing and prepared to work until the end of June, as will be stated in my resignation letter, but I'm wondering if 5 months notice is 'too much.' The organization is having a difficult time recruiting for the position I'm currently in and I want to provide them with as much notice as possible to try and find a replacement.

I'm concerned that the company may terminate my employment sooner than my stated last day, which is a risk I will take. However, if that's the case, would I be able to collect Employment Insurance Benefits?

I live and work in Canada.

I suggest you visit your nearest Service Canada outlet to have your question reviewed by them. Unfortunately to receive benefits when you voluntarily leave employment automatically cancels you out unless you can prove just cause for extenuating circumstances.

I doubt you can receive unemployment, so you need to consider this. Also consider trying to change your plans to do it in 5 weeks.

Also no, just give standard notice, I have seen people give a 4 month or 2 month notice and be told to leave the next day.

And to top it off, not that they know you are leaving they can look for a replacement and let you go without notice, unless you are covered by a contract
