OK, my wife was working for a nursing home in Texas. First of all they fired her for being pregnant(she is 3.5 months along) and then they "lost" 2 weeks of her pay records. They doctered her pay stubs to show that her orientation started on the 23rd when it also happened about the 10th. Does anyone know what and if we can do anything about this? It doesn't seem right that they could fire her for that, and I know that the hour thing isn't right, but how could we prove it?

They can fire you for any reason, as long as she didn't have an iron clad contract. That's why its called AT-WILL employment.

I also assume she's not in a union. And you are right... if you are going to try and sue on the other... you are going to have to present proof of the alligations or it will never see a courtroom. Even if they did do it but covered their tracks very well.

Father had a case where an employer was playing games to avoid paying severance... and they got away with it for over 20 years until ONE person said the wrong thing in an email and it was seen by the right person... was a class action suit.
