View Full Version : If my boss not pay me for sickness day, is it illegal ?

I work in a private company as full time employee for over a year now. I only have basic 4% vacation pay which my boss paid me off at end of year if I didn't take the 2 weeks holiday during the year. But once a while, when I have sickness day off even
For only a few hours or only one day, he always deduct it from my bi-weekly pay check. Does he legal to not pay me for the sickness day off?

Are you paid hourly or salary?

I receive my pay by hourly.

Your employer is not obligated to pay you for time that you are not working.

Our office building hydro had been shut off for a week because the city had to fix the broken water bump. If he refuse to pay me for that week, is he illegal?

Where are you at ? Here in the US, unless you have a contract, if he tells you to stay home, it is not paid.

Since you are an hourly employee he doesn't have to pay you for time not worked.

I live in Toronto, Canada. I do have a yearly contract with my boss, it's automatically renew by each year. But I don't know what those information will make some different on this situation?

No. It doesn't change the answer. If you are paid by the hour, and aren't asked to work, you don't have a riight to get paid.

Unless, of course, there is something to the contrary in your contract.

In some areas, perhaps France or Greece they would have to pay for the time off.

In some contracts it would allow for certain personal time.

Also sometimes you are allowed to use vacation days for this. Did you ask about using a vacation day ?

But yes, if you don't work, you don't get paid.
