View Full Version : Can I be fired for being sick more than 10 times in 6 months

My supervisor advised me today that it was a possibility I may be termintaed for missing 10 days in 6 months. I currently am suffering from a cyst on my spine which is causing weakness in my left leg and numbness, surgery is inevitable and I am having it done at the VA, but I am concerned that my family may suffer if this happens. I have had sinus infections and bronchitis during these periods and wasn't told that if I would be off 3 or more days I could claim short term disability.
I found this out after I had missed my ninth day.

They are required to have FMLA posters in employee areas. And yes if you have excessive absences, unless you are covered by a contract they may replace you.

Sad to say that they can fire you for whatever reason they want. You have missed a lot of work. Are they aware of your condition? Did you provide doctors notes when you missed work?

Even if they were aware, and you did provide doctors notes, they can still let you go. They really don't even need a reason at all unless you're part of a union.

Are you a member of a union or do you have an employment contract?

Would your Doctor put you on disability pending your surgery so you have some income? You cannot collect unemployment if you are unable to work.
