I am in the middle of a pending case and as such, no conviction has been made yet. Unfortunately, crappy timing has me trying to get a job and all the opportunities I have will require a bacgkround check. My question is what will pop up when they search county, state and federal records? I can honestly answer the "have you ever been convicted of a felony, misdemeanor, etc" question with "no", but since I've been arrested, I'm not sure how to answer the "have you ever been arrested" question.

If I say "no" and it comes up, I will have lied and they won't hire me. If I say "yes" , it will raise a red flag and they won't hire me. What if they don't even check for arrest records and I didn't need to say anything? Others in a similar situation have told me that they cannot look for arrest records and thus, I should say "no". But I'm not sure I believe them I am so stressed out! Any advice would be welcomed! Thanks!

No, if the question is have you ever been convicted, you answer no, since you have not been convicted. Arrested is not convicted.

Thanks for the reply. I'll definitely check "no" to the have you been convicted question. But what do I do if I am asked about arrest history?

Normally you are not, few places ask about arrests, only convictions unless this is for a police or national security position. But if asked you be honest and tell the truth

I think I'm screwed... this is what I found out:

CARCO conducts a search of a proprietary database that consists of 453 million current and historical arrest, felony, misdemeanor, incarceration, conviction, fugitive, escapee, absconder, and probation records on over 230 million offenders. Neither CARCO's supplemental criminal database nor that of our competitors should be considered a "national criminal check". When run as a standalone search this and other similar competitor databases are incomplete and not considered FCRA compliant. In the event of a hit or potential hit, CARCO ensures accuracy and FCRA compliance by taking the next step and completing a county and/or statewide search based on the preliminary hit information provided through this database.

This search is NOT intended to replace a regular county or statewide criminal search. The purpose of this search is to provide an additional level of due diligence in an effort to discover criminal activity outside the established criminal search locations.
