I am in the middle of a pending case and as such, no conviction has been made yet. Unfortunately, crappy timing has me trying to get a job and all the opportunities I have will require a bacgkround check. My question is what will pop up when they search county, state and federal records? I can honestly answer the "have you ever been convicted of a felony, misdemeanor, etc" question with "no", but since I've been arrested, I'm not sure how to answer the "have you ever been arrested" question.
If I say "no" and it comes up, I will have lied and they won't hire me. If I say "yes" , it will raise a red flag and they won't hire me. What if they don't even check for arrest records and I didn't need to say anything? Others in a similar situation have told me that they cannot look for arrest records and thus, I should say "no". But I'm not sure I believe them I am so stressed out! Any advice would be welcomed! Thanks!
