I am a salaried employee who had used up all sick and personal days. I ended up missing 11 days between Oct. to May. Now my employer wants to dock 11 days off this paycheck. Can he do this?

Yes, if you have gone over your allotted paid time off then you can be docked for full days missed. However, it has to be full days.

Even though they are docking you for missed days from past pay periods.

Yes, why would the fact that it is previous pay periods matter? It may have taken them time to process the overage of your allotted time.

Bottom line if your employer has a specific amount of allotted paid time off and you exceed your allotment, then it becomes unpaid time off. Your employer ia allowed to dock your pay. The only thing is that the policy has to be applied equally to all. So if you have a co-worker who exceeded their allotment ans was not docked, then they cannot dock you.
