View Full Version : How can I have an unlawful detainer removed from my credit report?

I recently applied for an apartment. I was denied because it showed I had 3 unlawful detainers 2 of them were dated while I still residing at the residence and the most recent in January of 2010. I was not served and was not aware of the UL. I need to have these removed from my record and was told I need to file a motion to set aside the judgment. I am not sure where to go and the eviction was filed after the company was reported to Envirnomental Services and there were several violations. I was informed by the housing department that I was able to withhold rent until the repairs had been completed. The company was notified and fixed 3 of the 9 violations and then 2 weeks later I received something from the court advising an eviction had been filed and when I went to respond that day, I was informed that I would not be able to because the papers had been filed and I was in default

You need to do your research and go to the courthouse and get the paperwork. Examine it and see what it says.

I have received the file and I want to know how to file a motion to set aside the judgment. I was not served because the date they are providing I spent the night at a friends and did not get home until that afternoon. It also says it was sent in the

Your question appears to be chopped off. Are you asking about monetary judgments or something else?

Unlawful detainers are not judgments.

Please use the reply box instead of the comment box when you respond.

You very possibly did not need to be personally served - nail and mail (which is the slang) is acceptable in most States.

I need to know the rest of what you typed in order to give any other advice.

Califdad is correct, by the way, if you don't already have the specifics of the judgment/unlawful detainer.

There was no monetary judgment issued. The rental company did not proceed with trying to collect any money because I was within in the law by withholding the rent.

Unlawful detainers appear on your credit and is considered a judgment that is why I am unable to find another apartment shows a I have judgments for this when the credit report was pulled by the rental agency I recently applied with
