My children's father was just sent to prison for 27 years and still has another trial coming up for a separate crime and will probably be in prison for the rest of his life. They offered him a 50 year plea on the one coming up and he did not take it. My question is, I am going to file for divorce and get on with my life without my husband. Is there anyway to get child support from someone in prison, i.e. social security benefits maybe?

Does he have some form of ss income? It is more likely that a judge would order the minimum amount your state figures for support because he obviously isn't getting an income in prison. What state are you in? That will play a big part in this too.

You could go to the local County Family Assistance office and ask them what your child is entitled to from the County or the State.

Unfortunately I am unable to tell where your from however if you from the uk then you could get income support as a lone parent as long as your child/children are under 16 years and you receive child benefit and have no more than £16k in savings and capital. If you are still classed as a couple then maintence will be scrapped however tax credits and income support will help support you and your children where your husband is unable you should contact your local social security office to start proccedings

No, unless he has lots of money in the bank where you can get paid, no if he is in prison he is not able to pay you.
