    Step Father Adoption
    Can a step father adopt children when the biological father is in jail? Does he have to have consent if the father is being deported back to Mexico?

    Most courts will not grant an adoption without the biological parent's agreement.

    Yes, you will need to biological fathers consent, he must sign away his rights, jail or Mexico.

    Yes. The biological father has to give his consent, regardless of being incarcerated, an illegal immigrant, etc.
