My husband wants to adopt my 3 yr old
Me and my husband have been married for 1 yr and he wants to adopt my son. When I was 15 I got pregnant by a 24 yr old. He had previously got in trouble for having communication with a minor for immoral purposes. When he convinced me to run away and come live with him. When my parents found out they prosecuted him, since they could not prove we had sex he just got communication with a minor for immoral purposes, and a restrain order was issued. He had convinced me to keep in contact with him. I then ended up getting pregnant 4mths later. He then never showed any interest in my son in fact he moved when he found out. Then came back just before I had him. Only to be in my life. He never has supported my son at all. He has had no contact with us in a year by his chose. He has our phone #and address, and yet we have not heard from him. My son had no clue who he is. He only knows my husband as his dad. On my sons birth certificate it has no father named since I was ashamed of what happened. Now I want to put all that behind me and have a normal family. Do I need to contact his bio-logical father to get him to terminate his right, although he really doesn't have any since he is not on the birth certificate or pays any kind of support.

My father is not on my birth certificate and when I decided I wanted to be adopted by my stepfather I never once thought about asking my father how he felt. I never did get adopted because I was told that I didn't need to go through the whole process but I did take on my stepfathers name. The only time it makes a difference is legal documents i.e. for a passport or marage certificate etc. I say get your son adopted. His father clearly doesn't know what he's missing out on and your son will be better off.

The judge would probably require you to notify the biological father and give him a chance to respond before granting your husband's petition to adopt.
