    Home Office Exemption
    My employer is located 135 miles away from my home. I have worked for them for 6+ years and have been allowed to work remotely from home from day 1. In the beginning I still had an office there... for the past 2 years I have NOT had an office or phone there. I work from my home office as a Recruiter and maybe twice a month travel 135 miles each way to have face time at our headquarters. I live alone and have a 2 bedroom condo. I have made my second bedroom into an office complete with desk, dual monitors, laptap docking station, printer, bulletin board with all my important docs, etc. I also have a guest bed in that room which is used maybe twice a year.

    Do I qualify for the Home Office Exemption? I ask because (1) I am unsure about whether it is at the convenience of the employer but assume since I don't have an office there I meet that requirement. And (2) I am concerned about whether it is considered exclusive use since I do have a bed in the office, but it is hardly ever used maybe a couple times a year.

    Thoughts?
