    Sister in law charged with theft under 5000.00
    My sister in law is being charged with frauding her place of work for theft under 5000.00 I was just wandering being it's her first offence what may be the things she will have to do and I was wandering if this would cause her to go to jail considering she has 4 children. It was a home for special needs people and she stole there bank card and took money I think it was 2 people but I'm unsure of all the details. I appreciate any replys I'm just afraid she may have to go to jail and I worry for her children

    I am sorry, she stole the bank card from two special needs people? She needs some seroius jail time and she should have worried about her kids going to their father or to foster care when she did it.

    Because of the victims, there are even special laws protecting them in many states, seroiusly she will be looking at jail time.

    Her only real hope is to pay back all of the money ASAP before court, and work out a deal with the DA

    I'm a little confused - did she steal from her place of work OR steal the bank cards of two residents?

    Either way she's in trouble but if she stole from the disabled she should be in jail without question. She is also not fit to raise 4 children.

    I've posted before that as my husband was dying a hospital employee stole his wedding ring and a credit card out of his wallet - in this instance I believe less in the law and more in karma - so I have absolutely no sympathy for your sister's situation. She took advantage of an already sad situation.

    Okay I know she was wrong wasn't asking for your nasty remarks just want to know where she stood so we knew what to do with her kids. There is no doubt in my mind she was very wrong. THE MAIN CONCERN IS HER KIDS!! I'm not asking for any of your sympathy for her I never said she deserved any but I'm worried about her kids, my nieces.

    I don't think I was being nasty - if there is some other word to describe what has happened here, I'll be happy to use it.

    Anyway - she could go to jail; she could get probation; she could get both. She could get fined. She could lose her license to work (assuming she has some sort of medical license); she probably will be ordered to never work with the handicapped, elderly, young again. She may never be able to work in a position handling money. She will have to pay a fine. She will have to make restitution. If she goes to jail someone will have to take her kids in or they will end up in foster care. She will probably be on probation at some time or another. She may need to go for regular drug/alcohol testing.

    Did she turn herself in or was she caught?

    Only a Judge knows what the sentence will be and the circumstances will play a large part in the sentencing. How large a hardship she created for the people she stole from will play a part.

    How good is her Attorney? Are you willing to take in and support her children?

    I don't know if that statement will fly in Court and that's up to her Attorney but it certainly could be part of her plea deal and is a compelling argument.
