    Can a sex offender live with or get custody of his children?
    I'm an aunt to three beautiful boys, ages 3, 9, 10. Their father is going to federal prison for child pornography acts and communication and sending and receiving photos of a 13 yr old girl. His "devoted" wife has forgiven him "this time"( has cheaed on her for the last 10 yrs) , and wants him in her and his children's lives when he gets out. This is not good! He is a horrible man. He left them for 6 months one time to starve because they had no income to run around on her. That's just part of the back ground story. The question is does he have any right to live with the children as a sex offender? And if something were to happen to their wife can he get custody after he gets out of the pen? Please help. What can I do!

    No judge in his right mind would allow that man near any children, let alone his own. I don't think you have to worry in that case

    I would hope his case and his situation would be reviewed once his parole came up. If I were you I would keep tabs on him. When is he up for parole ?

    I know I'm jumping the gun, he hasn't been sentenced yet he's in custody,1 yr in dec. waiting. His lawyer is trying to get him to plead guilty for a reduced sentence if not he gets at least 10 yrs. So it doesn't matter what his wife wants?

    Yes, correct. It doesn't matter what his wife wants. It is a moot point

    I hope the judge he gets has a real vendetta against juvenile sex offenders. Most countries have zero tolerance in this issue, because once a sex juvenile sex offender, always a juvenile sex offender.

    Yes, and yes. As a father he shares legal and physical custody of his children with their mother. He has these custody roghts unless and until those rights are modified, either by a civil decree or order (divorce, etc.), or by the terms of a criminal sentence.
