    What was your legal status prior to the child's death, are you listed on birth certificate or been proven father though court ?

    Did you have court appointed visits ?

    Was or is there any reason why you could not have custody.

    Normally unless there is a reason you can't get custody you should be able to get it.

    Without details we can't help. First, ANY question about law needs to include your general locale as laws vary. Second, why don't you have custody now? Are you the legal father? Have you been a part of the child's life? Do you have joint legal custody? How long ago did she die? Without those details and more we can't help.
